Domain Statement
What this domain covers
Policy instruments live or die on their statutory text. Research in this domain produces legislative discussion drafts and the analysis behind them: which authority a measure rests on, which branch controls it, how it would fare under judicial review and in international fora, and which drafting choices close or open the exposure. Each draft is published with the reasoning that shaped it, so staff can evaluate the choices rather than take them on assertion.
Analytic questions
- What authority does a measure rest on, and does existing law already provide it?
- Which branch controls the decision, and what procedure does the statute require?
- How would the strongest challenge be stated, and what is the probable outcome?
- Which drafting choices reduce the exposure, and which risks cannot be drafted around?
Methods Applied
- Statutory and precedent analysis
- Adversarial review of draft text
- Section-by-section drafting notes
- Citation verification against primary sources
